SECOND CHAMBER CUT-OFF PASSES

ONE WEEK LEFT IN SESSION

SPECIAL SESSION POSSIBILITY

Today was (theoretically) the last day to pass bills out of their second chamber (House bills out of the Senate, Senate bills out of the House). HB 1713 appears to have died awaiting a floor vote in the Senate. HB 2410 passed by Senate, sent to the governor. HB 2793 was amended and passed by the Senate, so it has to go back to the House for them to concur in the amendment. HB 2908 was also amended and passed by Senate, so it, too, goes back to House for concurrence. SB 6165 was amended in the House and passed, so it heads back to the Senate for a concurrence vote. SB 6267 appears to have died awaiting a floor vote in the House.

The 2016 regular session comes to an end next Thursday, March 10^th . The bills that were sent back for concurrence must be voted on by the Senate or House before being sent to the governor. Bills can still die as the clock runs out.

The principal focus of the second (short) session of the biennium is passage of the supplemental budget. If that fails to pass in the coming week, a special session will be called.

GOAL POSITION ON HB 2908 CHANGES FROM OPPOSE TO NEUTRAL

The second chamber (House bills in the Senate, Senate bill sin the House) policy committee cut-off was today. All of the firearm-related bills we are tracking passed their respective committee.

HBs 1713 and 2793 passed out of Senate Human Services and were sent to Senate Ways & Means for approval of funding. HBs 2410 and 2908 passed out of Senate Law & Justice and sent to Senate Rules for a floor vote. HB 2908 was amended to add pro-law enforcement organizations to the working group making recommendations on law enforcement use of deadly force. SB 6165 was amended in committee to clarify the language that assembling your own short-barreled rifle from separately purchased components is legal – provided you are using a legally registered (under the National Firearms Act) SBR receiver. Good clarification. SB 6267 passed to House Rules.

HB 2908 was amended in the Senate Law & Justice Committee today. Our position has changed from “oppose” to “neutral” now that rank-and-file law enforcement officers will be given a voice in the working group. The recommendations of this working group could ultimately lead the legislature to change the rules regarding the use of lethal force by all citizens of Washington.

Monday, 29 February is the second chamber fiscal committee cut-off. HBs 1713 and 2793 must pass Ways & Means Monday or die for the session. Friday, 4 March is the last day for bills to pass out of the second chamber, with the exception of those bills amended in the second chamber which must go back to the first chamber for a concurrence vote.

Two weeks remain in the 2016 regular legislative session. The session must end by midnight on Wednesday, 10 March.

PUBLIC HEARINGS SCHEDULED – (Initial hearing schedule updated per addendum – ed.)

Bills that had not passed out of their original chamber (House bills out of the House, Senate bills out of the Senate) died Wednesday evening. Now the focus flips: Senate bills in the House, House bills in the Senate.

Only six firearm-related bills remain in play during the 2016 session. SB 6165, by Sen. Takko (D-19) passed the Senate and is now in House Judiciary. SB 6267, by Sen. Schoesler (R-9) passed the Senate and is now in House Judiciary. HB 1713, by Rep. Cody (D-34) passed the House and is now in Senate Human Services, Mental Health and Housing. SHB 2410, by Rep. Hayes (R-10) passed the House and is now in Senate Law & Justice. HB 2793, by Rep. Orwall (D-33) passed the House and is now in Senate Human Services, Mental Health and Housing. Finally, HB 2908, by Rep. Ryu (D-32) passed the House and is now in Senate Law & Justice.

Three weeks remain in the 2016 regular legislative session. The train is speeding up. Next Friday, 26 February, is the second chamber policy committee cut-off. Again, bills that do not pass out of their policy committee by that date are dead for the session.

A public hearing will be conducted on HB 1713 In Senate Human Services, Mental Health and Housing committee on Monday, 22 February at 10: 00 a. m. A hearing will be conducted on HB 2908 in Senate Law & Justice at 8: 00 a. m. on the 23rd . A public hearing on SB 6267 is scheduled in House Judiciary at 10: 00 a. m., 23 February. A public hearing will be held on HB 2793 in Senate Human Services on 25 February at 10: 00 a. m. At this time no other bills are scheduled for public hearing, but that is subject to change.

SB 6267 PASSES SENATE

Tuesday evening was the fiscal committee cut-off. HB 1857 failed to pass House Appropriations and is likely dead for the session. HB 2793 goes to House Rules awaiting a call to the House floor.

Bills that have passed out of their policy committee and a fiscal committee (if required) go to the House or Senate Rules Committees, where they await a “pull” to the floor. Essentially, the Rules committee votes on which bills to bring to the chamber floor that day, and which wait… or die. Not all bills that make it to Rules receive a floor vote (vote of the entire House or Senate). Recognize, too, that a lot of bills in the Rules committee are holdovers from last year and unlikely to move this year as well.

At the time the weekly schedule was published, no gun bills were scheduled to be heard. As bills move to the floor for a chamber vote, then pass to the other chamber, bills may be scheduled.

5 p.m., Wednesday, 17 February is the chamber cut-off. All House bills under consideration must pass out of the House to the Senate. All Senate bills must pass out of the Senate to the House. Bills that do not pass their original chamber are supposedly dead for the session. (I say “supposedly” because on rare occasions the rules are suspended and bills come back to life.)

SB 6267 (Schoesler (R-4) passed out of the Senate. It will likely go to House Judiciary next week.

GOAL Post Addendum6 February 2016

House Bill 2325, by Rep. Dick Muri (R-28), a bill that would create an
elective hunter education/firearms safety course in high schools, failed
to pass out of the House Education Committee by yesterday’s policy
committee cut-off.The bill is essentially dead for this session.

In a late addition to next week’s schedule, Rep. Muri has arranged for a
“courtesy hearing” on the bill by the House Education Committee in House
Hearing Room “A,” John L. O’Brien Office Building at 8:30 a.m. on
Thursday, 11 February. WDFW Hunter Ed officials will be there as will
several state-certified hunter education instructors.

If you can attend the hearing, please try to do so.A hunter ed/firearm
safety course in our high schools would go a long way to counter the
anti-gun indoctrination and misinformation that fills classrooms today. A
strong showing of support will help get this bill a hearing in the next
legislative session.

Of the more than 60 gun-related bills filed during the 2015-16 biennium, only a few have survived the 2016 first policy committee cut-off. Because bills that do not pass out of their original policy committee (for most gun bills — but not all — House Judiciary or Senate Law & Justice) are considered dead for the session, I will annotate that in tonight’s “bill status” portion as “Died. ”. Next week I will only post those bills that are still under consideration in the remainder of the session.

A few new bills were filed this week, but none received a public hearing or a vote out of committee before tonight’s deadline. HB 2951, by Rep. Scott (R-39) would override employer’s prohibitions on keeping firearms and/or ammunition in motor vehicles parked in company parking lots. This protects customers AND employees. HB 2974, by Rep. Shea (R-4) prohibits confiscation of private personal property (including firearms/ammunition) during a state of emergency. HB 2975, also by Rep. Shea, creates the Washington state firearms civil rights act, an act that guarantees the right to keep and bear arms, prohibits public officials or employees from interfering with that right beyond existing law, and allows lawsuits against individuals in violation. It also provides sentencing enhancement for those who carry, brandish or discharge a firearm in the commission of a crime. All three bills are effectively dead as they were filed too late for a hearing. But they’ll be back.

The GOAL position on HB 1713 (guns/mental health) has changed from OPPOSE to NEUTRAL based on adoption of a substitute bill. The bill is now in House Appropriations awaiting committee action.

HB 2907 failed to pass committee, but a near duplicate, HB 2908 passed to House Rules committee.

Public hearings were held this week on HBs 2907 and 2913. Executive action (amendments and votes) were taken on others. HB 2410, which would have applied a blanket mandate to add to the “firearms offender registry” anyone convicted of a firearms offense. The bill was amended to mandate inclusion of only violent or sexual predator offenses, omitting the requirement to add technical violations such as I-594 transfer violations. An amendment to exempt concealed pistol licenses from the suspensions mandated by HB 2913 failed. GOAL still opposes the bill. (If HB 2913 becomes law, it will likely be challenged in court. )

Tuesday, 9 February marks the technical halfway point in this 60-day session. From a legislative standpoint, the halfway point occurs six days later, 17 February, the days bills must pass their original chamber (House bills from the House, Senate bills from the Senate) or they are considered dead. There’s still a lot of damage that can be done before the session ends.

FIRST POLICY COMMITTEE CUT-OFF NEXT FRIDAY

(Same deal as last week. I’m on the road to Jacksonville, FL, for the annual meeting of the Florida Sport Shooting Association. The information cut-off is once again Thursday night vice Friday. )

Last week while I was at SHOT in Las Vegas I missed one gun bill, HB 2410, b y Rep. Hayes (R-10). HB 2410 amends the existing “felon firearm registry” to mandate inclusion of a convicted felon’s name (or someone found not guilty by reason of insanity) in that list. Under current law, inclusion is a judgment call, based on the circumstances involved, of the court. Rep. Hayes has informed me that he has an amendment to his bill to narrow the mandate to those convicted of violent felonies, not I-594-style technical violators. GOAL position on the bill is SUPPORT WHEN AMENDED. ––

HB 2867, by Rep. Scott (R-39), would allow CPL holders to carry concealed firearms on college campuses. HB 2893, by Rep. Kuderer (D-48) is another bill trying to use mental health to ban guns. HB 2907, by Rep. Moscoso (D-1) narrows the existing use of force by peace officer (and those assisting peace officers) law. HB 2913, by Rep. Gregerson (D-33) would allow suspension of various state-issued licenses for failure to pay court-ordered child support. (Recall your history lessons about debtor’s prisons back in the 1600s-1700s – can’t pay the bill, go to jail. Suspending a professional license will sure help child support payments. )SB 6603, by Sen. Fain (R-47) is a companion bill to HB 2793, addressing suicide awareness and prevention. SB 6621, Sen. Fraser (D-22) creates a task force to study policing and use of deadly force.

Public hearings were held this week on several bills: SBs 6158, 6165 and 1267 and HBs 2410, 2793, and 2603. Next step is for the committee chair to schedule a vote in committee in executive session. If the bill is voted out of committee, it moves to the Rules committee awaiting a floor vote, or to a fiscal committee if it has major fiscal impact. The decision to move a bill out of committee rests with the committee chair. He or she may call for a vote, or they may sit on it.

Two public hearings are scheduled next week on gun bills. HB 2913, by Rep. Gregerson (D-33) will be heard in House Judiciary at 8 a. m. on Wednesday, 3 February. HB 2907, by Rep. Moscoso (D-1) will be heard in House Public Safety at 1: 30 p. m. on Wednesday, 3 February as well

Next Friday, 5 February, is the cut-off for bills to pass out of their first policy committee (most gun bills out of House Judiciary or Senate Law & Justice). Theoretically, bills that do not move on through the process are considered dead for the session (subject to extraordinary action, rarely). That means most of the bills on the “active” list will drop out and we can narrow our focus, as well as support for or opposition to a narrower number of bills.

I’m “on the road” in Las Vegas, just wrapping up the annual Shooting, Hunting, Outdoor Trades (SHOT) show conducted by the National Shooting Sports Foundation — the trade organization that represents the U. S. gun industry. My “information cut-off” for this issue was Thursday night. – JW

11 new gun-related bills were filed this week. HB 2653, Rep. Cody (D-34) would grant a tax exemption for “smart” guns; HB 2712, Rep. Wilson (R-17) would add carjacking to the justification of the use of lethal force and add civil immunity to someone found acting in self defense; HB 2738, by Rep. S. Hunt (D-22) would require a person carrying a concealed handgun under the authority of a CPL to get express permission from the homeowner before being allowed to take a handgun into a home; HB 2793,by Rep. Orwall D-33 is a suicide prevention education bill drafted with the aid of the NRA and SAF; HB 2794, also by Orwall (D-33) amends existing temporary mental health law to allow law enforcement input; HB 2814,by Rep. Klippert (R-8) encourages development of recreational shooting areas in locations governed by the Growth Management Act; and HB 2836, by Rep. Farrell (D-48) requires gun owners to maintain liability insurance. On the Senate side, only four bills:SB 6351, by Sen. Habib (D-48) guts state preemption of uniform firearm laws; SB 6352, by Sen. Frockt (D-46) is another “extreme risk protection order” bill; SB 6487m by Sen. Becker (R-2) expands authorized use of lethal force to include carjackings and affords civil immunity in self defense; and SB 6515, by Sen. O’Ban (R-28) would create an elective hunter ed program in high schools.

A public hearing on several gun bills was conducted in House Judiciary on Thursday. I was not able to attend, nor have I had a chance to review the TVWashington coverage of the hearing. Two public hearings on gun bills are scheduled for next week. On Monday, 25 January, the Senate Law & Justice Committee will take public testimony on SBs 6158, 6165 and 6267. All three are solid pro-gun bills and deserve our support. On Tuesday, 26 January, the House Judiciary Committee will hear HB’s 2794 and 2603. As noted above, both the NRA and the SAF were involved in drafting HB 2793, and fully support this bill. Of the alleged 30,000 deaths annually due to “gun violence,” 20,000 (2/3) re suicides — hardly “gun violence. “Involvement of the gun lobby in promoting suicide prevention shows responsibility and maturity in addressing this issue. Both NRA and SAF will have representatives on the committee formed. No anti-gun organizations are included. On the other hand, HB 2603 is another attempt to blame the gun for the misuse of guns by certain individuals.

The legislature adopted its calendar for the 2016 regular session.The
legislative calendar sets dates by which bills must clear various
hurdles.A bill that fails to clear the policy committee or chamber floor
by the designated date is generally considered dead for the year,
although they may be “resurrected” by parliamentary procedure.  Be sure to check the legislative calendar!

A recent Gallup poll indicates more voters identify as politically
“independent” over either the Democrat or Republican parties.42% of
those polled self-identified as independents, while 29% called
themselves Democrats and 26% Republicans.Both major parties have been
losing fans for several years.Dissatisfaction with
partisan-politics-as-usual is at an all-time high.How that will play out
in the elections remains to be seen.

Nine new gun-related bills were filed this week, most anti-gun.HB 2372,
by Rep. Senn (D-41) mandates destruction of firearms forfeited to
police; HB 2374, also by Rep. Senn, imposes a tax on ammunition sales;
HB 2460, by Rep. Walkinshaw (D-43), guts state preemption,; HB 2461, by
Rep. Jinkins (D-27) revisits extreme protection orders; HB 2481, by Rep.
Blake (D-19) allows short-barreled rifles; HB 2553, by Rep. Wilson
(R-17) guarantees possession and use of arms in a declared state of
emergency; HB 2603, by Rep. Kuderer (D-48) mental health and guns; SB
6267, by Sen. Schoesler (R-9) requires CPL renewal notice; and SB 6310,
by Sen. Jayapal, mandatory gun storage.It would appear the Democrats are
looking at 2016 as a gun control year, at least in the House.

House Judiciary chair Rep. Laurie Jinkins has designated Thursday,
January 21st as House gun bill day, the first of this session. At 1:30
p.m. she will take testimony on five gun bills in a public hearing: four
of them anti-gun, one pro.HBs 1747 (lock up your gun), 2461 (extreme
protective orders), 2372 (destruction of forfeited firearms), 2460 (more
gun free zones) and 2481 (allows short-barreled rifles) are all on the
agenda.

HB 1747 does nothing but demonize guns.It’s already considered reckless
endangerment to leave ANYTHING out that might harm a child: not just
guns, but toxic fluids, cleaning agents, bleach, etc.

HB 2461 broadens the opportunity for a family member, household member
or law enforcement to petition a judge to take away your guns – no
mental health professional involvement necessary.Have an argument with
your significant other?They might come after your guns.

HB 2372 requires law enforcement agencies to destroy forfeited
firearms.Current law allows them to be auctioned off to FFLs where they
may returned to service, with required background checks.This is more
demonization of guns because they think guns are veil.

One of the most important gun laws in Washington is RCW 9.41.290 – State
Preemption.This means that, with certain limited exceptions, only the
state legislature may pass gun laws in the state.Counties and cities are
prohibited from writing their own laws.This has been law since the early
1980s and has served as a model for other states.But obviously the other
side doesn’t like this. The latest attack on preemption comes in HB
2460, Walkinshaw (D-43), that would allow political subdivisions to ban
guns in parks and recreational facilities, libraries, and on public
transportation.Coming on the heels of a judge’s decision that Seattle’s
gun and ammunition tax didn’t violate preemption (currently under
appeal), this is the most serious attempt yet to overturn this
critically important law.

And the one good gun bill, HB 2481, which would allow Washington
citizens to possess short-barreled rifles, provided they complied with
federal law ($200 federal tax, extensive background check, restrictions
on movement).Short-barreled rifles AND shotguns were legal until 1994,
but once again, the “guns are evil” crowd prevailed and had them banned.

Note that the position on HB 1119 has changed from SUPPORT to
OPPOSE.This change is based on a request from the Hunters Heritage
Council and other hunting groups who oppose the bill for two reasons:it
allows a fee to be collected for heretofore free Hunter Ed classes, and
it sets a minimum age for youth hunting (8 for accompanied, 14
unaccompanied). HHC believes the parent is the best judge of when a
youngster is mature enough to hunt.The focus of GOAL Post, and my
expertise, is in the area of firearms law, not hunting regulations.I am
deferring to their judgment.
