I missed a &#8220;1.&#8221; It&#8217;s March 13th! Ten more days to pass bills that threaten the constitution, threaten your wallet, or both!.<\/p>\n<p>20 of 33 county commissions in New Mexico and their sheriffs have publicly stated their opposition to proposed gun legislation, declaring the proposals unenforceable. Not surprisingly, NM&#8217;s Democrat governor has ridiculed the sheriffs. Apparently, it&#8217;s not just Washington sheriffs who have decided enough is enough.<\/p>\n<p><!--more-->Several years ago a number of sheriffs and other law enforcement officers got together and formed the Constitutional Sheriffs and Peace Officers Association (cspoa.org). Their position is that the sheriff is the highest executive authority in any of our 3,000+ counties, and thus constitutionally empowered to override certain federal legislation. This concept has obviously evolved down to state legislation as well. This will be interesting to follow.<\/p>\n<p>HB 2133, by Rep. Mike Steele (R-12), amends the state explosives act. The current act prohibits those convicted of violent felonies from working in the business or using explosives. This bill expands the prohibited list to include all those prohibited of owning firearms (certain misdemeanants, protective or restraining order subjects, etc). The bill continues the exemption for small arms ammunition and limited reloading supplies, so it has no practical effect unless you are an employee or major explosives user \u2013 but the expansion is simply overreaching and sets a bad example.<\/p>\n<p>Note that almost all bills in the &#8220;support&#8221; category died last week. Don&#8217;t take any joy that the &#8220;assault weapon ban&#8221; bills died &#8212; that issue is tied up with I-1639 in the courts \u2013 but note the magazine ban bills ARE still moving.<\/p>\n<p>I&#8217;ve listed the bills that died at last week&#8217;s committee cut-off as &#8220;died.&#8221; Next week I&#8217;ll leave them out entirely to reduce clutter and confusion. But keep in mind we have a two-year legislative biennium \u2013 all these bills spring back to life next January. Or in any special session between now and then. And the make-up of the legislature remains the same, with solid Democrat majorities in both the House and Senate. The process is theirs to control.<\/p>\n<p>SB 5954, bump stock buyback funding, passed the Senate unanimously. The bill allocates $150,000 to fund last year&#8217;s unfunded buyback program at $150 per bump stock.<\/p>\n<p>Nine more House bills and 13 Senate bills await a call to their respective chamber floor for a vote. Bills that pass out of their original chamber go to the second chamber to begin the process all over again: policy committee assignment, possible public hearing, a committee vote and then possibly a second chamber vote. We&#8217;re not quite halfway through the session, with most of the serious action still ahead.<\/p>\n<p>Next week the floor action will be fast and furious, with several possible evening sessions on the schedule.
