There’s been a little motion on our five bills of interest after a week of public hearings. HB 1100 passed out of Senate Law & Justice to Senate Ways & Means. HB 1612 passed out of Senate Human Services to Senate Ways & Means. Both of these will have to clear that fiscal committee before moving on.
Senate Bill 5268 passed out of House Judiciary to House Appropriations, more fiscal action. SB 5552 still sits in House Rules awaiting a floor vote (not likely until next month). A public hearing was held on HB 1501, so we can expect it to be subjected to a Senate Law & Justice committee vote next week.
The second chamber (House bills in Senate, etc) policy committee cut-off is next Wednesday, 29 March. We’re past that with the five bills we’re following. The fiscal committee cut-off is the following Tuesday, 4 April. HBs 1100, 1612 and SB 5268 are awaiting that hurdle.

SECOND CHAMBER POLICY COMMITTEE CUT-OFF
The committee hearing/vote/floor session cycle has started all over again, after the 8 March original chamber cut-off. As House bills move through the Senate and vice versa, the next critical cut-off date is Wednesday, 29 March — nearly two weeks off. The second half of the long session is off to a slow start. Of the five gun bills we are tracking, two had public hearings (1612 and 5268) and one passed out of committee (5552).
Senate Bill 5552, relaxing SOME of the background checks under I-594, passed out of 5552 amended and out of the House Judiciary Committee on what appeared to be a unanimous a voice vote on Wednesday. The bill was amended in committee to add firearms loaned to veterans color guards to the list of background check exemptions.
Recall this is the bill that COULD be amended to add CPL holders to the exemption list. That would change it from minor tweaks to a major pro-gun bill. But that’s going to take pressure from constituents. The bill can be further amended on the House floor at the end of March/early April..
At this point, two bills (1100, 1501) are scheduled for public hearings and an executive session for 5268. Details below.

5 p.m. on Wednesday was chamber cut-off: House bills that had not passed out of the House, and Senate bills that had not passed out of the Senate, died for the session. We are now down to a very manageable list of five bills to follow. 34 gun bills were filed this year, nowhere near the 60+ filed in the last two year biennium. And as is typical, most never passed the half-way mark.
As the 5 o’clock bell rang in Olympia on Wednesday, the House still hadn’t reached HBs 1122, 1483 and 1731. The Senate stopped short of SB 5506. So those bills should be considered dead for the session, but the Senate version of HB 1731, SB 5552, is still running in the House. Keep in mind, too, that this is the first year of a biennium, meaning all the bills filed this year that did not make it can be called back next year. Or during any special session.
And now there are five. HB 1100, HB 1501, HB 1612, SB 5268 and SB 5552 Two of the bills are essentially duplicates: HB 1100 and SB 5268 both mandate mailing a renewal notice 90 days before a CPL expires, a long overdue fix. The HB 1100 was amended in the House, so it will have to be reconciled with SB 5268 in the next four weeks. HB 1501 requires FFLs to notify the State Patrol of NICS denials, who are then directed to initiate an investigation (many/most of which will go nowhere because of misidentifications). HB 1612 promotes suicide awareness education. And SB 5552 is the Senate version of the minor tweaks to I-594 background checks (e.g. no check required for in-laws, or for loans at the range where the owner stays with the firearm).
Not much of a positive outcome midway through, but if you look at all the anti-gun bills filed, it’s encouraging to see none got traction. We’re not going to see pro-gun bills sail through until a pro-gun House is put in place to match a pro-gun Senate.
Public hearings will be conducted on HB 1612 and SB 5268. SB 5552 will be subject to an executive session (committee vote). Details below.
We’re halfway through the session, and already the bill list is down to five. But it’s not over yet. And should a shooting incident occur that “fits” one of these bills, you can expect them to try and revive it. The fat lady doesn’t sing until midnight on 23 April!

From a gun bill perspective, this has been a slow week. HB 1100 (CPL renewal notices) passed out of the House, but in amended form (the Senate version, SB 5268) passed clean last week). That means the two versions will have to be reconciled, either by one chamber accepting the other’s language, or by a conference committee later in the session. HB 1501 (reporting of NICS denials) and HB 1612 also passed the House. All are headed for Senate Law & Justice.
At week’s end, one other gun bill is on the House floor calendar: HB 1731 (I-594 tweaks). Three others, HBs 1122 and 1483, and SB 5506, have yet to be placed on their respective (House or Senate) floor calendar. The cut-off is next Wednesday, 8 March. Note that, historically, non-controversial bills are generally moved first to “clear the deck” for those with major disagreement.
As it sits right now, HB 1731, like SB 5222, makes some minor tweaks to ease some of the background check burden imposed by I-594 by adding a few more small exceptions to the requirement. An amendment to HB 1731, proposed by retread (he previously served in the House from 1995-2001) Representative John Koster (R-39) would make a significant change by allowing transfers without background checks if both parties to the transaction were Washington CPL holders.
The ATF has already acknowledged our CPL meets the highest federal standard by designating Washington a “NICS Alternative state” for federal checks (blocked by I-594), in addition to which it has passed by an internal Washington state criminal history check plus a Dept of Social and Health Services check. Plus CPL holders have a track record of good behavior, something someone walking off the street into a gun shop may not have. This is about the most common sense rationale you could use for a 594-waiver. If pre-cleared individuals are not granted a waiver, this clearly demonstrates that I-594 was not about background checks but about gun registration via FFL recordkeeping (something “background check” supporters continue to deny, admitted in public testimony in the Senate back in 1997 – “we want the audit trail”).
A public hearing is scheduled for SB 5552 (limited I-594 exemptions) in House Judiciary on Thursday, March 9, This is the first of the gun bills that passed out of one chamber to now start its way through the second. See details below.

In a week or two I’m going to trim the list of bills under consideration, deleting those that did not survive the committee or chamber. That will give us a more manageable list to follow. At the end of the session I’ll publish a session recap with the complete bill list.
The fiscal committee cut-off is tonight. All bills that needed fiscal approval and did not get it died. At this time it appears that HB 1270 and SB 5073 likely died in their respective fiscal committees. I’ll correct any changes next week. HBs 1501 and 1612 passed out to House Rules. At this point there are nine bills still left alive out of 34 originally filed.
The next major cut-off is in twelve days, March 8th, when all bills must pass out of their original chamber (House or Senate). We’ll likely see a handful of the remaining bills die at that point.
Two gun bills have successfully passed out of the Senate, to be taken up by the House after the 8 March chamber cut-off date. SB 2268 (CPL renewal notice) and SB5552 (expanded exceptions to I-594) both cleared the Senate on a 49-0 vote. Neither was controversial!
For the next ten days, all of the action will be on the chamber floors as bills are called up, debated, possibly amended, and then an up or down vote. Floor sessions are televised on TVWashington for the masochists on the GOAL list. And there should be a link on the legislative web site (leg.wa.gov).
(To give you an idea of the magnitude of a legislative session, more than 2,300 bills have been filed so far in this session. As stated before, many are filed, few receive action.)

GOAL Post 2017-6 was published last Friday, but apparently did not receive complete distribution.
I’ve been publishing GOAL Post since 2000, primarily in direct e-mail format through my home ISP. As the subscriber list grew, I broke it up into segments of about 200 names each. Every Friday night during session, no problem. Compose message, hit “send” button, and it magically goes out of my mailbox into yours. Until last Friday, when all of the batches were kicked back, theoretically as spam I will continue to try e-mail, but I’m working on alternatives, among them, posting GOAL Post on the web pages of the Washington Arms Collectors and the Washington State Rifle & Pistol Association. About 18 months ago, a friend and co-worker created a “GOAL” web site which I never paid much attention to, as he merely posted the current GOAL Post during session. Unfortunately he passed away last year, and at this point I cannot access the site.
Two more bills I should have been tracking deal with firearms in the broader sense, but do not come under RCW 9.41, our state’s firearms code. HB 1270, by Rep. Harmsworth (R-43) encourages voluntary use of firearm locking devices by offering a tax saving. A similar law waiving the sales tax on gun safes was passed nearly 20 years ago. HB 1612, by Rep. Orwall (D-33) expands on the suicide prevention program initiated last year, and supported by gun rights organizations. Both bills are still alive.
Tonight is the first major cut-off day, when all bills must pass out of their policy committee. Those that are not moving forward are most likely dead for the session. That’s about 2/3 of them, good or bad. The “Bill Status” column below shows the current status for each bill we’re tracking. Basically, if it doesn’t have a position in Rules or a fiscal committee, it’s dead for the session.
Remember, nothing is really “dead” until the fat lady sings, on April 23rd. While rare, extraordinary action may be taken to revive a bill, or even file a new one.
The good news is that Attorney General Bob Ferguson’s flagship bills banning and/or registering so-called “assault weapons” all died in committee. They tried to salvage the registration bill in the House by watering it down, narrowing the definition of “assault weapon,” deleting magazines, eliminating the annual licensing, etc, but even that couldn’t get the required votes to get out. Stand by for an initiative. The House version of the safe storage bill DID pass, but in amended and watered down form. It’s still a bad bill, as well as totally unnecessary – current reckless endangerment law already covers the topic. Unfortunately almost all pro-gun bills died as well.
Bills that have a significant fiscal impact have an additional week to pass out of one of the fiscal committees. That cut-off is next Friday. Keep in mind this is the biennial budget year, and if they fail to pass a budget, we could be looking at one or more special sessions, as happened a couple of years ago.
The next critical cut-off is March 8th, when bills must pass out of their original chamber (House bills out of the House, Senate bills out of the Senate). If they don’t make the cut, they’re nominally dead. Most action will be on the chamber (House or Senate) floor, where bills will be debated and passed… or not. After March 8th, those bills that passed out of their original chamber will go through the same process – on the other side: committee hearing and possible action, fiscal committee action if required, then into the Rules committees while awaiting a full chamber (floor) vote.
All bills considered on the floor are subject to a roll call vote. Because of their numbers (98 members), the House does it by machine – a quick red-green machine vote, called the Christmas tree (probably the only politically correct Christmas tree in the capitol). The Senate, with only 49 members, does it the old fashioned way – a roll call voice vote.

SB 5795, by Senator Chase (D-32), would mandate firearm owners have personal liability insurance to purchase or possess any firearm. No minimum coverage amount is specified, but you must show your policy to the FFL to purchase a firearm.
After a deeper evaluation of HB 1384/SB 5256, I am dropping them from the gun bill tracking list. As clarified, a “sexual assault protection order” is separate and distinct from a domestic violence protection order and is NOT to be used in lieu of a DV protection order. It does NOT automatically prohibit firearm possession.
After consulting with law enforcement professionals, I am changing the GOAL position on SB 5441 (involuntary freeze on firearm possession) from “OPPOSE” to “NEUTRAL.” The “consultees” are both rock solid pro-gun individuals with more than 60 years combined law enforcement experience, most of it on the street.
Washington gun owners need a push on HB 1933 and SB 5506. These bills would allow transfer of a firearm without I-594 background check at non-profit events such as Ducks Unlimited or Friends of NRA dinners. HB 1933 has not been scheduled for a hearing in House Judiciary. SB 5506 was considered in a public hearing but no executive session (committee vote) has been scheduled. If no action is taken on these bills by next Friday (17 Feb), they are dead for the session. Please call or e-mail your Representatives and ask them to push HB 1933 in House Judiciary and your Senator to push SB 5506 in Senate Law & Justice.
Public hearings were conducted last week on HB 1100, HB 1501 and HB 1731. No executive action (committee vote on HB 1100 yet. Executive session (committee vote) on HBs 1501 and 1731 are scheduled for 16 Feb, along with HBs 1122, 1387, 1529 and SB s 5506 and 5552.the last day to get bills out of committee.
(After the hearings, and outside (state agency, other public agency, private citizen) input is heard, the committee staff prepares a “bill report” that describes the effect of the bill as submitted, a summary of public testimony, and includes any amendments to the bill offered by legislators. The bill next has to be scheduled for a vote (passage) in executive session, by the committee chair. Once a vote is taken – IF a vote is taken (not all bills heard get an up or down vote) — the bill dies in committee or moves on, either to the Rules committee awaiting a floor vote, or to a fiscal committee for their review.)
A public hearing is scheduled for SB 5441 in Senate Law & Justice on Thursday, 15 Feb at 1:30 p.m.
Next Friday is the original chamber policy committee cut-off day, meaning all House Bills that have not passed out of their original policy committee are (nominally) dead for the session, with the exception of bills with a fiscal impact – they have an extra seven days to pass out of one of the fiscal committees (Appropriations or Ways & Means). I threw the word “nominally” in there because a bill CAN be resurrected after missing a cut-off, but it’s extremely rare.

A few new gun bills were introduced this week. HB 1592, by Rep. Klippert (R)8) waives the handgun delivery waiting period for active commissioned police officers as currently exists for CPL holders. Long overdue. HB 1900, by Rep. Griffey (R)35) authorizes issue of a special “NRA” license plate to help fund hunter education programs. HB 1933, by Rep. Rep. Walsh (R)19) waives the I-594 background check requirement for firearms transferred via a not-for-profit activity such a Friends of NRA or Ducks Unlimited.
(Note on HB 1900: The current listed position on HB 1900 is “neutral.” Not because I oppose funding hunter ed or have a problem with the NRA – I have been a life member of that organization for several decades – but that I believe we would be better served by a plate that recognizes the Second Amendment to the bill of Rights as broader and more inclusive. I would also add that we have two national gun rights organizations based right here in Washington – why single out just the NRA? Disclosure: I have worked for both SAF and CCRKBA, and I have been an NRA election volunteer coordinator and certified firearms safety instructor.)
Correction: HB 1100 (renewal notice for CPL) now sits in House Appropriations awaiting a determination of fiscal impact and a committee vote.
Public hearings were held on several bills last week. Of particular interest was the hearing in House Judiciary conducted on February 2nd. Historically, pro-gun individuals out number anti-gunners at these events. It appears the other side has noticed this and went out of their way to make a strong showing on Thursday. They wore orange and filled the room early, effectively hogging the camera coverage. We need to do better, gang. I was also told that there were a couple of buses, including one school bus, parked outside that may have carried these individuals to Olympia, also not a new tactic of the left. A similar incident occurred in Tallahassee, Florida, last week, when dozens of women wearing “Everytown for Gun Safety” orange t-shirts crammed a gun bill hearing. Funny thing, when the hearing ended, the women were seen turning their t-shirts over to a few League of Women Voters “volunteers.” “Everytown” is a Michael Bloomberg front group and LWV never met a gun control bill they did not support.
Public hearings are scheduled next week on HB 1100 (CPL renewal notice) and HB 1731 (exceptions to I-594). Details below.
HB 1384 (Sexual force protection order) was amended in committee to allow for a rehearing to end or limit the court order. It passed out of committee on a 12-1 vote and moves to House Rules, the “holding pattern” for a full floor vote. The bill is still offensive in that it puts the burden of proof on the accused to show he/she poses no threat.
SB 5260 (CPL renewal notice) passed out of Senate Law & Justice and now awaits a call to the Senate floor out of Rules.
Note that just as which bills are heard by a committee is solely at the discretion of the committee chair, so is the decision to call a bill up for a committee vote. With two weeks left until the first (policy committee) cut-off, most bills have not been scheduled for a hearing. We may see a last-week rush, we may not. This is where your contact with legislators is important – to push to hear a bill or block it – grassroots lobbying at its best.
